Sexual Harassment is prohibited

    The Î÷Ê©Ö±²¥APP is committed to the elimination of sexual harassment in district schools and activities. Sexual harassment is strictly prohibited and will not be tolerated. This policy prohibits sexual harassment of students or staff by other students, staff, Î÷Ê©Ö±²¥APP members or third parties. "Third parties" include, but are not limited to, school volunteers, parents, school visitors, service contractors or others engaged in district business.

     

     

    District programs and activities

     

    The Board shall not tolerate the sexual harassment of any student by any other student or any district employee. Any student or employee who is found guilty of sexual harassment shall be subject to disciplinary action.

     

Sexual Harassment in employment defined

  • Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment when:

     

    1. Submission to the conduct is made either an explicit or implicit condition of employment, status or promotion.

    2. Submission to or rejection of the conduct is used as the basis for an employment decision affecting the harassed employee.

    3. The harassment substantially interferes with an employee's work performance or creates an intimidating, hostile, or offensive work environment.

    4. Submission to, or rejection of, the conduct is the basis for any decision affecting benefits, services, honors, programs or other available activities.

Sexual Harassment of students defined

  • Sexual harassment consists of unwelcome sexual conduct, including advances, requests for sexual favors, sexually motivated physical conduct or other verbal or physical conduct or communication of a sexual nature when:

     

    (1) Submission to that conduct or communication is made a term or condition, either expressed or implied, of obtaining an education; or

    (2) Submission to or rejection of that conduct or communication by an individual is used as a factor in decisions affecting an individual’s education, grades, or participation in any school activities; or

    (3) That conduct or communication has the purpose or effect of substantially or unreasonably interfering with an individual’s education, or creating an intimidating, hostile or offensive education environment.

     

    Examples of sexual harassment include, but are not limited to, the following:

     

    (1) Sexually oriented verbal harassment or abuse;

    (2) Subtle pressure for sexual activity;

    (3) Sexually inappropriate patting or pinching;

    (4) Intentional brushing against a student’s body;

    (5) Demanding sexual favors accompanied by implied or overt threats concerning an individual’s educational status;

    (6) Any sexually motivated unwelcome touching; or

    (7) Sexual violence that is a physical act of aggression that includes a sexual act or sexual purpose.
